Terms of Service

These terms govern the provision of design services (branding, logo, packaging, digital assets) by Newchoice. By commissioning work you agree to these terms. Key points include scope, deliverables, invoices, payment terms (14 days unless otherwise agreed), cancellation, and ownership transfer.

  • Quotations are valid for 30 days.
  • 50% deposit for new projects unless agreed otherwise.
  • Final artwork delivered after full payment.

Australian Consumer Law & Guarantees

Newchoice complies with the Australian Consumer Law (ACL). Services come with guarantees that cannot be excluded, including that services will be rendered with due care and skill and be fit for the disclosed purpose.

If a service fails to meet an ACL guarantee, we will remedy the failure (for example by re-performing the service) or offer a refund where appropriate and proportional to the work completed. Revision rounds are set out in the project scope.

Deposits secure scheduling and are non-refundable except where required by law. Cancellation charges may apply for work already performed.

If you consider your consumer guarantee has not been met, contact us at Newchoice@gmail.com. If unresolved, you may refer the matter to your local consumer protection agency (e.g., Consumer Affairs Victoria) or the Australian Competition and Consumer Commission (ACCC).

Intellectual Property

Unless otherwise agreed in writing, copyright in deliverables is retained by Newchoice until final payment. Upon full payment, ownership of final deliverables is assigned to the client, excluding Newchoice pre-existing materials and third-party assets licensed for use.

Clients must not use work in a way that breaches third-party rights. Trademark registration remains the client's responsibility.

We collect and process personal information necessary to supply our services. Our practices are described in full in the Privacy Policy, including data retention, third-party processors, and your rights under the Privacy Act 1988 (Cth).

Dispute Resolution & Governing Law

These terms are governed by the laws of Victoria, Australia. If a dispute arises, please contact us to resolve internally. If unresolved, consumers may seek assistance from Consumer Affairs Victoria or the ACCC. For business-to-business disputes, parties agree to first attempt good faith negotiation.
